Digital Millennium Copyright Act (DMCA) & EU Copyright Policy

1. Introduction and Scope

GIT2LOG LLC / JSC Git2Log Kazakhstan (the "Controller", "we", "us") respects the intellectual property rights of others and strictly complies with the Digital Millennium Copyright Act (17 U.S.C. § 512), the EU Digital Services Act (DSA - Regulation (EU) 2022/2065), and the EU Directive on Copyright in the Digital Single Market (Directive (EU) 2019/790). This Policy outlines our "Notice and Action" procedures for reporting alleged copyright infringement on git2log.com (the "Website").

2. Important Notice Regarding Dynamic External Content (GitHub)

Please read carefully before submitting a notice. The Website utilizes external API integrations to dynamically render content. Specifically, certain code snippets, repository states, and organizational data displayed on the Website are fetched in real-time from servers operated by GitHub Inc. via their API.

  • The Controller does not host, store, or control the source code displayed within these dynamic widgets on its own server infrastructure.
  • If you believe that code or content rendered via the GitHub integration infringes your copyright, you must submit your DMCA takedown notice directly to GitHub Inc. * The Controller cannot remove content from GitHub’s servers. Takedown notices directed at us regarding dynamically rendered external API content will be discarded as unactionable.

If you believe in good faith that static content hosted directly on our Website’s server infrastructure (including but not limited to article text, blog posts, news data, publications, and multimedia files) infringes upon your copyright, you may submit a formal Takedown Notice to our Designated Copyright Agent.

To be legally valid under the DMCA and EU DSA, your notice must be in writing. We strongly recommend using our dedicated Report Form for expedited processing. Whether submitted via the form or email, your notice must include the following elements:

  1. Physical or Electronic Signature: The signature of a person authorized to act on behalf of the owner of the copyright interest.
  2. Identification of the Original Work: A clear description of the copyrighted work that you claim has been infringed.
  3. Identification of the Infringing Material: The exact URL(s) on the Website where the allegedly infringing material is located, with sufficient detail to enable us to locate it.
  4. Contact Information: Your address, telephone number, and email address.
  5. Good Faith Statement: A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. Penalty of Perjury Statement: A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

4. Submitting a Counter-Notice

If your content was removed (or access to it was disabled) as a result of a DMCA/DSA takedown notice, and you believe this was done by mistake or misidentification, you may submit a Counter-Notice. It must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed and the exact URL at which the material appeared before it was removed.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, telephone number, email address, and a statement that you consent to the jurisdiction of the courts in your location, and that you will accept service of process from the person who provided the original notification.

5. Repeat Infringer Policy

In accordance with applicable US and EU regulations, the Controller maintains a strict "Repeat Infringer" policy. We reserve the right to permanently terminate access to the Website for any user, IP address, or network node that is found to repeatedly infringe the intellectual property rights of others, or who repeatedly submits fraudulent or bad-faith takedown notices.
